These Terms of Service ("Terms") govern your access to and use of the Niche Careers platform operated by Niche Careers ("we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

Niche Careers provides a platform that enables customers to create and operate niche career boards on custom domains. Our services include website hosting, job board management tools, themed design, analytics, and related features as described on our website.

2. Account Registration

To use our services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our services.

3. Subscription and Billing

Our services are offered on a subscription basis. By subscribing to a plan, you agree to the following:

• Subscription fees are billed monthly or annually, depending on your chosen billing cycle
• All fees are quoted in US dollars and are non-refundable unless otherwise stated
• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
• We reserve the right to change our pricing with 30 days' advance notice
• Failed payments may result in suspension of your account and career board

Free trial

We offer a 14-day free trial for new accounts. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using the services. If you do not subscribe, your career board will be deactivated.

Upgrades and downgrades

You may upgrade or downgrade your subscription plan at any time. Changes take effect at the start of your next billing cycle. Upgrading mid-cycle may result in a prorated charge.

4. Acceptable Use

You agree not to use our services to:

• Post fraudulent, misleading, or deceptive job listings
• Distribute spam, malware, or other harmful content
• Violate any applicable laws, regulations, or third-party rights
• Collect personal information from users without proper consent
• Interfere with or disrupt the integrity or performance of our platform
• Attempt to gain unauthorized access to our systems or other users' accounts
• Post content that is discriminatory, harassing, or promotes illegal activity
• Resell or redistribute our services without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

5. Content and Intellectual Property

Your content

You retain ownership of all content you submit to your career board, including job listings, company descriptions, and branding assets. By uploading content, you grant us a limited license to host, display, and distribute that content as necessary to operate the service.

Our platform

The Niche Careers platform, including its design, code, features, and documentation, is our intellectual property. You may not copy, modify, distribute, or reverse-engineer any part of our platform without written permission.

6. Custom Domains

You are responsible for owning or having authorization to use any custom domain you connect to your career board. We are not liable for domain registration, renewal, or DNS-related issues. You must ensure your domain does not infringe on any trademarks or third-party rights.

7. Availability and Support

We strive to maintain high availability of our platform but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. Support response times vary by plan tier:

• Starter: Email support, response within 48 hours
• Professional: Priority support, response within 24 hours
• Enterprise: Dedicated account manager, response within 4 hours

8. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our services, you consent to the data practices described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Niche Careers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of our services.

Our total liability for any claims arising from these Terms or your use of the services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Niche Careers and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the services, your content, or your violation of these Terms.

11. Termination

Either party may terminate the subscription at any time. Upon termination:

• Your career board will be deactivated at the end of the current billing period
• You may export your data within 30 days of termination
• We will delete your data within 90 days of termination, unless retention is required by law
• No refunds will be issued for partial billing periods

We may terminate or suspend your account immediately if you violate these Terms.

12. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Niche Careers operates, without regard to conflict of law principles.
